1) Alabama Horse Riding Instructor Accused of Sex Crimes Released on Bond
An Alabama horseback riding instructor accused of sexually abusing multiple teenage girls is off house arrest. Dismissal is better than Acquittal



Rape/Sex Abuse Case Dismissed

Getting his client acquitted was the goal, but attorney Randall Snow acknowledged a dismissal before trial is even better.  A Marion County prosecutor finally gave up after months of litigation, trial set-overs, and aggressive defense of a Measure 11 Rape/Sex Abuse.  The complainant alleged that her ex-boyfriend came to her home, took her into her bedroom and forcefully raped her. She showed police what she claimed were bruises which the police photographed and produced through discovery. Snow recognized the color of the bruising seemed coincidentally close in color to her eyeshadow coloring.

Testing also showed the “bruising”  appeared to have smudged onto her bra strap, an important fact oddly overlooked by police.  “I would hope that it was only an oversight” commented Snow, “but what was apparent to us in photographs would seem to be more apparent in live viewing.” 

Snow revealed numerous inconsistencies in the complainant’s stories which the State finally acknowledged with dismissal stating “insufficient evidence.”

Sex Crimes Defense Case Study

Sodomy, Sex Abuse I and Sex Abuse III, Not Guilty on all counts.

Salem attorney Gig Wyatt tried this multiple count Measure 11 indictment the 1st week of Sept in Polk Co. After 2 days of testimony, the 12 person jury returned a unanimous verdict of Not Guilty in under 30 minutes. The jury was polled, and when the last juror said she agreed with the verdict, the alternate juror spoke out “make that 13!”
 A specially appointed prosecutor and judge from another county had to hear the case since the defendant was known to the local legal community.

The complainant had told police that she was sleeping when the defendant attempted to have sex with her. The testimony, however, showed that their relationship involved consensual sex for 2 years and that she had motive for ending the relationship.

Wyatt pointed out several important inconsistencies between her story to the jury and the story she told police.  “When a jury believes the witness is lying, it doesn’t take long for them to decide a person has been victimized by her, not the other way around,” Wyatt pointed out.
Wyatt also pointed out that she testified in another hearing related to the case that she would feign sleep in order to avoid contact, a point which also helped the jury feel the State’s case was weak.

Sex Crimes Defense Case Study: Polk County Acquittal on Marital Rape


A 41 yr old man was acquitted of 2 counts of Rape, 2 counts of Sex Abuse and 1 count of Strangulation in Polk Co on April 30, 2014.  His wife made the accusations 1 year after the alleged incidents took place. 

The state alleged forcible compulsion, the highest degree of Rape and Sex Abuse. Defense attorney Gig Wyatt pointed out that the allegations were made after defendant’s wife learned her husband had an illicit affair. 

Wyatt told the jury “you have to be an armchair psychologist here. You can see her hurt, her anger, and the way she has transferred her pain into this accusation. This is her only way she can hurt him back.”  

She alleged that he had raped her on 2 different occasions, but the defense pointed out that those occasions were on days he was returning from being  out of town with his mistress. Again, Wyatt pointed out, she pointed to the very dates when he hurt her and turned those into false accusations.  The defendant was convicted of 1 ct of misdemeanor assault. “I didn’t think the facts supported that offense, but I think the jury wanted to acknowledge her pain in some way,” Wyatt commented.  The defendant was given misdemeanor probation stating, “I’m very happy with the result.”

Rape and Kidnapping Case Dismissed in Woodburn

Sexual crimes defense attorney Gig Wyatt had a case dismissed after questioning the evidence of the alleged victim and complainant.
Recently published in the Woodburn Independent :

Micky Henson, M & M Towing owner, has been found not guilty of rape 1 and kidnapping 1. The verdict was handed down in Marion County Circuit Court Tuesday morning, with Judge Susan Tripp presiding.
“We think the evidence was clear that the complainant was not entirely reliable,” said Gig Wyatt, Henson’s attorney.


Henson was arrested Feb. 28, 2013. A probable cause statement released by the Marion County Sheriff's Office included graphic descriptions of Henson’s alleged forceful rape and captivity on Feb. 17 with a part-time female employee on River Road. Wyatt confirmed Henson initially denied having sex with his employee, but later stated the sex was consensual.

Case dismissed.

Sex Offenders, Sexual Crimes, and the Law

A sexual crime in Oregon is defined as as any activity involving non-consensual sexual acts, whether by force, coercion, young age, or inability to consent (e.g., unconscious, extreme intoxication, or asleep). Sex offenses include a range of behaviors, from public indecency and prostitution to rape and child molestation. A range of various crimes stated above involve underage children, and many times the Internet is an important part of the investigation and the defense of the suspect who is charged with a sexual crime.

When charged with a sexual crime, you may be arrested, and subject to criminal proceedings that may result in acquittal, or sentencing of time in prison. 


Because of the increasing use of the Internet by minors and children, criminal charges may include Internet usage to share illegal images and to lure potential victims to a meeting place. The FBI has increased their enforcement and tracking of Internet related sexual crimes.


Criminal charges for illegal sexual crimes will usually involve law enforcement to have access to check the personal computer of the accused. Illegal search and seizure may be a common defense if a search warrant was not in force and if the suspect was not present.
